The shocking state of US LGBTQ+ rights in 2023

State legislators across the United States have been responsible for an alarming surge in anti-LGBTQ+ bills in the past 12 months, according to a recent investigation. The American Civil Liberties Union (ACLU) reports that a staggering 508 bills targeting the LGBTQ+ community have been introduced, while the independently researched trans legislation tracker puts the number at an even higher 589 bills across 49 states.
To put this into perspective, a conservative estimate suggests that 174 bills were filed against the LGBTQ+ community in 2022, meaning that the count has increased by more than 230 percent this year. Bloomberg reported that US state legislatures passed last year’s number of bills as early as March.
However, it is important to note that a significant percentage of these anti-LGBTQ+ bills failed to become law. The ACLU reported that only 84 bills passed into law, while 227 were defeated or are still being processed. This discrepancy raises questions about the true intentions behind the introduction of these bills, with activists arguing that their primary goal is to instill fear in the LGBTQ+ community and divert attention from pressing issues facing the country.
In an interview with PinkNews in May, trans Montana representative Zooey Zephyr shed light on this issue, describing the legislation as a way of masking “inadequate solutions to major crises” facing the US. Zephyr faced backlash and was censured for speaking out against legislative attacks on LGBTQ+ individuals. She highlighted the deep housing crisis in Montana and criticized Republicans for failing to address this issue adequately.
The wave of anti-LGBTQ+ bills being introduced is not happening in isolation. Right-wing politicians in Republican-controlled states have created carbon copies of extreme anti-LGBTQ+ laws that threaten the existence of LGBTQ+ rights. States including North Carolina, Louisiana, Missouri, and Texas have passed laws restricting healthcare for LGBTQ+ people, particularly trans individuals.
This barrage of legislation has had a serious impact on how activist groups and human rights organizations combat homophobia and transphobia in the US. The ACLU, in particular, has intensified its efforts to push back against these bills through grassroots court actions. Currently, the organization is fighting 14 bills in court. Pro-LGBTQ+ politicians have also been pleading with their rivals to help block as many of these bills as possible.
Despite the continued attacks against the LGBTQ+ community, there have been significant legislative wins against the Republican-led anti-LGBTQ+ movement. Governors in several states, including Louisiana, Kentucky, California, and North Carolina, have vetoed anti-LGBTQ+ bills that would have restricted healthcare or censored freedom of expression. Arizona’s Democrat governor Katie Hobbs has vowed to veto any and all anti-trans bills that reach her desk.
However, the fight for LGBTQ+ equality is far from over. Independent journalist Erin Reed emphasized the importance of remaining vigilant and highlighted that many states are moving in the right direction. Reed described 2023 as “one of the most important” years in the rise of anti-LGBTQ+ legislation but expressed determination to push back against these discriminatory measures.
As we look ahead to 2024, it is difficult to see Republicans reversing their homophobic and transphobic policies. This year has given us a deeply worrying taste of what the right-wing is capable of.
