Maths teacher sacked after refusing to use trans student’s new pronouns, tribunal told

An employment tribunal has heard that maths teacher Kevin Lister, 60, was sacked by New College Swindon in Wiltshire for gross misconduct after he refused to use a transgender student’s new pronouns. Lister is claiming unfair dismissal, stating that he was let go because he objected to being forced to use pronouns that did not align with his beliefs.
The incident began in September 2021 when a 17-year-old transitioning student, known only as Student A, requested to be addressed by a male name and pronouns. Lister reportedly refused to comply with the student’s request, leading to complaints from other students. The college ultimately decided to terminate Lister’s employment for his refusal to use the requested pronouns.
During the employment tribunal at Bristol Civil Justice Centre, Lister argued that being required to use the student’s preferred pronouns amounted to “compelled speech.” He expressed concerns that the college’s policies were designed to push students towards transgender advocacy groups and that it was not his role as a maths teacher to confirm a student’s gender transition.
Lister stated, “She does not have the right to compel teachers and other students who do not share her views,” emphasizing his belief in the importance of teaching factual information without imposing personal beliefs. He maintained that his refusal to use the student’s chosen pronouns was not about discrimination but rather about his right to uphold his own beliefs.
In response, Jude Shepherd, the barrister representing the college, defended the institution’s policies, stating that they do not prevent staff from being respectful and inclusive towards all students, regardless of their gender identity. The hearing is ongoing, with both sides presenting their arguments before a decision is reached.
The case raises important questions about the intersection of personal beliefs, freedom of expression, and inclusivity in educational settings. Should teachers be required to use a student’s preferred pronouns, even if it conflicts with their own beliefs?
